Guilty plea to sexual abuse of mentally incapacitated adult

Today, October 5, 2015, in Muscatine County District Court:

RUSSELL PURVIANCE, JR., 46, of Muscatine, pleaded guilty to sexual abuse in the third degree. Investigation by the Muscatine Police Department showed that PURVIANCE had sexual intercourse with an adult female who was mentally incapable of giving consent due to her intellectual disability.

PURVIANCE faces a mandatory sentence of incarceration for a term not to exceed 10 years when he is sentenced November 13, 2015, at 9:30 a.m. In addition, when his sentence is served he will be on supervised release as if on parole for the remainder of his life. He will be required to register as a sex offender. The court revoked the defendant's bond pending sentencing. He is being held in the Muscatine County Jail.

"I am very pleased with the outcome of this case," said Muscatine County Attorney Alan R. Ostergren. "The offender is going to prison and the victim can look forward to getting on with her life without having to testify in court. I would like to especially thank Muscatine Police Department detective Joe Roseman for his work on this case. He got me the evidence I needed for a successful prosecution," he added.

Guilty plea to lascivious acts

Today, September 25, 2015, in Muscatine County District Court:

JORDAN ROBERT WINSLOW, 33, of Wapello, pleaded guilty to two counts of lascivious acts with a child. Investigation by the Muscatine Police Department showed that WINSLOW had hand-to-gential contact with two separate children approximately two years ago. He will be sentenced November 6, 2015, at 9:15 a.m.

Muscatine County Attorney announces results of investigation into officer-involved shooting.

PRESS RELEASE – June 24, 2015

Muscatine County Attorney Alan R. Ostergren released the following statement regarding an investigation into the use of deadly force by a law enforcement officer:

On June 9, 2015, Louisa County Sheriff’s Deputy David Perley was involved in a pursuit of a motor vehicle being operated by Richard Spurling. The pursuit ended near the intersection of Fruitland Road and Crimson Avenue in Muscatine County. Deputy Perley approached Spurling’s motor vehicle. Spurling drove his vehicle in the direction of Deputy Perley. Deputy Perley fired his service weapon in the direction of the operator of the vehicle. Spurling was struck once in the upper torso. He received medical attention and was transported to the hospital. He has subsequently been released from the hospital.

The Iowa Division of Criminal Investigation has conducted an investigation of the incident and shared the results of that investigation with the Muscatine County Attorney. After a review the Muscatine County Attorney has determined that the use of deadly force by Deputy Perley was lawful. This decision has been communicated to the Iowa DCI, the Louisa County Sheriff and to Deputy Perley.


Criminal charges related to the pursuit are currently pending in Louisa County against Spurling. No further information will be released at this time.

Guilty plea in burglary, robbery case

Today, May 13, 2015 in Muscatine County District Court:

DOMINIC CLESTER, DOB: 5/4/1992, of Muscatine, pleaded guilty to Robbery in the Second Degree and Burglary in the First Degree. Investigation by the Muscatine Police Department showed that on February 21, 2015, CLESTER was in an apartment in downtown Muscatine and refused to leave when told to by the resident. CLESTER assaulted the victim and stole property from her. In the course of the incident the victim was injured. CLESTER will be sentenced July 2, 2015, at 9:00 a.m. He will be held without bond in the Muscatine County Jail until that date.

JOSE ANTHONY TAPIA, DOB: 10/15/1996, of Muscatine, pleaded guilty to Delivery of a Controlled Substance, cocaine. Investigation by the Muscatine County Drug Task Force showed that TAPIA sold approximately 3/4th of an ounce of cocaine to an informant. TAPIA will be sentenced June 19, 2015, at 9:45 a.m.

JOVANY JACQUES, DOB: 112/21/1985, of West Liberty, pleaded guilty to Delivery of a Controlled Substance, cocaine. Investigation by the Muscatine County Drug Task Force showed that JACQUES sold approximately 1/8th of an ounce of cocaine to an informant. JACQUES will be sentenced June 19, 2015, at 10:00 a.m.

EDUARDO MANUEL GONZALEZ, DOB: 5/4/1991, of Muscatine, was sentenced after having pleaded guilty to Sexual Abuse in the Third Degree. Investigation by the Muscatine County Sheriff's Office showed that GONZALEZ sexually abused an adult female at a rural Muscatine County residence. GONZALEZ was sentenced to serve an indeterminate prison sentence of not to exceed 10 years. In addition he will be on lifetime supervised release as if on parole and will be required to register as a sex offender.

Prison sentence for meth lab fire, other felony dispositions

Today, February 20, 2015, in Muscatine County District Court:

DAVID REINIER, DOB: 6/28/1984, of Muscatine, was sentenced after pleading guilty to Arson in the First Degree, a class "B" felony. The Court imposed a prison sentence of not to exceed 25 years. The charge was the result of an investigation into a fire caused by a methamphetamine lab in a building being used as a residence by REINIER and his co-defendant. Two minor children were present in the structure when the fire broke out. The case was investigated by the Muscatine County Drug Task Force and the Iowa State Fire Marshall.

REINIER's co-defendant, AMY LORETTA LYNN HARMON, DOB: 6/4/1990, of Muscatine, was also sentenced today for her role in the fire. She received a suspended ten year prison sentence for Manufacture of a Controlled Substance. She was placed on supervised probation for a period of four years.

Prison sentence for burglary and weapons charges

Today, January 23, 2015, in Muscatine County District Court ZACKARY MARVIN JONES, DOB: 4/30/1993, of Muscatine, pleaded guilty and was sentenced for the offenses of burglary in the third degree and carrying weapons. Investigation by the Muscatine Police Department showed that JONES had participated in the burglary of a residence in which property, including a firearm, was taken. The Court imposed concurrent prison sentences for a total term of not to exceed five years.

CURTIS CHARLES FARRAR, DOB: 7/19/1988, of Wapello, admitted to a probation violation in a prior drug case as well as a new operating while intoxicated, second offense charge. The Court imposed concurrent prison sentences for a total term of not to exceed five years.

VERONICA NUNEZ-GARCIA, DOB: 10/27/1972, of Muscatine, pleaded guilty to delivery of a controlled substance, to wit: cocaine. Investigation by the Muscatine County Drug Task Force revealed that NUNEZ-GARCIA delivered approximately one gram of cocaine to an informant in August, 2014. NUNEZ-GARCIA has a criminal history of prior felony drug trafficking and money laundering convictions. She will be sentenced January 29, 2015, at 9:00 a.m.

Guilty pleas in meth lab related structure fire

Today, January 9, 2015, in Muscatine County District Court:

DAVID REINIER, SR., DOB: 6/28/1984, of Muscatine, pleaded guilty to Arson in the First Degree, a class "B" felony punishable by imprisonment for a term not to exceed 25 years. On January 8, 2015, his codefendant, AMY LORETTA LYNN HARMON, DOB: 6/4/1990, of Muscatine, pleaded guilty to Manufacture of a Controlled Substance, a class "C" felony punishable by imprisonment for a term not to exceed ten years.

Investigation by the Muscatine County Drug Task Force and the Iowa State Fire Marshall showed that REINIER and HARMON had been involved in the manufacture of methamphetamine when they caused an accidental fire which destroyed the structure they had been using as a residence.

Both will be sentenced February 20, 2015, starting at 9:00 a.m.

Also occurring today, January 9, 2015:

ANGEL GONZALEZ, DOB: 10/21/1993, of Muscatine, was sentenced after pleading guilty to Lascivious Acts with a Child and Indecent Contact with a Child. Investigation by the Muscatine Police Department showed that GONZALEZ had sexually related contact with a minor on two occasions. GONZALEZ was sentenced to a total term of not to exceed 12 years imprisonment. Following completion of his term of incarceration he will be on the sex offender registry and lifetime parole.
