Muscatine County District Court

The following occurred December 28, 2012, in Muscatine County District Court:

STEVEN JOSEPH LARUE, DOB: 4/26/1991, of Muscatine, pled guilty to Delivery of a Controlled Substance. Investigation by the Muscatine County Drug Task Force showed that LARUE delivered 19 tablets of a prescription medication listed as a Schedule II Controlled Substance to a confidential informant. He will be sentenced February 22, 2013, at 9:45 a.m.


The following occurred December 31, 2012, in Muscatine County District Court:

ARIEL ALEXANDRA SARGENT, DOB: 8/25/1993, of Durant, pled guilty to Burglary in the Third Degree and Theft in the Third Degree. Investigation by the Muscatine County Sheriff's Department showed that SARGENT entered a rural Muscatine County residence on two separate occasions with the intent to commit a theft. SARGENT will be sentenced February 8, 2013, at 9:45 a.m.

Muscatine County District Court 12/21/2012

Today, Dec. 21, 2012, in Muscatine County District Court:

JESSIE ISIAH SANDOVAL, DOB: 6/24/1994, pled guilty to the offense of Burglary in the Second Degree. Investigation by the Muscatine Police Department showed that SANDOVAL had entered a residence in Muscatine without the permission of the homeowner with the intent to commit an assault. SANDOVAL will be sentenced February 8, 2013, at 9:00 a.m.

LANDON WILLIAM CHAIRES, DOB: 2/10/1991, pled guilty to the offense of Possession of a Controlled Substance with Intent to Deliver. Investigation by the Muscatine County Drug Task Force showed that CHAIRES was in possession of approximately one ounce of marijuana which he subsequently sold to a confidential informant. He will be sentenced February 8, 2013, at 9:15 a.m.

Former insurance broker pleads guilty to theft

Today, December 17, 2012, in Muscatine County District Court SHAWN MICHAEL MASK, DOB: 10/17/1970, pled guilty to Theft in the First Degree. Investigation by the State of Iowa Insurance Division showed that MASK had misappropriated approximately $21,900 in client funds while employed as an insurance broker working in Muscatine. The Iowa Insurance Division had previously revoked MASK's license to deal in insurance products in the State of Iowa.

MASK will be sentenced February 1, 2013, at 10:00 a.m.

Muscatine County District Court 12/14/2012

On December 14, 2012, in Muscatine County District Court:

JOSEPH AXTELL, DOB: 4/16/1991, OF Muscatine, was sentenced for the offense of Criminal Mischief in the Third Degree. The Court imposed a sentence of incarceration for a term not to exceed two years and a fine of $625. AXTELL was arrested by the Muscatine Police Department after an investigation showed that he had damaged a motor vehicle. AXTELL had several arrests prior to his arrest in this case which resulted in the recommendation of a prison sentence.


DIANA LEE RICK, DOB: 9/9/1970, of Muscatine, was sentenced for the offense of Burglary in the Third Degree. The Court granted a deferred judgment and placed RICK on supervised probation. RICK was arrested by the Muscatine County Sheriff's Department after an investigation showed that she had been involved in a residential burglary.


MICHAEL WILLIAMS, DOB: 3/2/1990, of Davenport, pled guilty to Delivery of a Controlled Substance. WILLIAMS sold approximately one ounce of marijuana to an informant working under the direction of the Muscatine County Drug Task Force. WILLIAMS will be sentenced February 1, 2013, at 9:45 a.m.


JOEY GONZALES, DOB: 9/10/1979, of Muscatine, was sentenced for the offense of Sex Offender Registry Violation, Second or Subsequent Offense. The Court imposed a sentence of incarceration for a term not to exceed five years and a fine of $750. He was arrested after an investigation by the Muscatine County Sheriff's Office showed that GONZALES had failed to update his registration information. GONZALES had three prior convictions for this offense.


JEREMY ELLIS NEWBERRY, DOB: 9/19/1994, of Muscatine, pled guilty to the offense of Assault with Intent to Commit Sexual Abuse. Investigation by the Muscatine Police Department showed that he had performed a sex act against a thirteen year old child. He will be sentenced February 1, 2013, at 9:30 a.m.


KEVIN RALPH KOBERG, DOB: 9/14/1966, of Stockton, pled guilty and was sentenced for the offense of Child Endangerment. KOBERG received a deferred judgment and was placed on supervised probation for a period of two years. Investigation by the Muscatine County Sheriff's Office showed that he had intentionally used unreasonable force against his child.


DANIEL JOSEPH FOSTER, DOB: 1/18/1976, of Wapello, pled guilty to two counts of Delivery of a Controlled Substance. FOSTER sold approximately one ounce of marijuana on two occasions to an informant working under the direction of the Muscatine County Drug Task Force. He will be sentenced February 1, 2013, at 10:15 a.m.

Muscatine County District Court Dec. 7, 2012

Today, in Muscatine County District Court:

KAYLEEN SHARP, DOB: 6/18/1987, of Wilton, was sentenced following her guilty plea to Theft in the First Degree, Lottery Ticket Theft, and Tampering with Records. The Court suspended prison sentences of ten and five years respectively for the two theft offenses and imposed a six month jail sentence for the tampering charge. The defendant was also ordered to make victim restitution.

Investigation by the Muscatine Police Department showed that the defendant had stolen currency and lottery tickets from her employer over an eight month time period.


ISAIAH HITZ, DOB: 6/6/1994, of Muscatine, was sentenced after pleading guilty to two counts of Theft in the Second Degree. The Court imposed concurrent sentences of imprisonment for a total term of not to exceed five years in the Iowa Department of Corrections. The defendant was also ordered to make victim restitution. HITZ was arrested by officers of the Muscatine Police Department after an investigation showed that he had participated in the theft of personal property and motor vehicle from a residence in Muscatine.


JOSE ROCHA, DOB: 10/18/1966, of West Liberty, was sentenced after pleading guilty to Theft in the Second Degree and Domestic Abuse Assault. The theft investigation was conducted by the Muscatine County Sheriff's Department and revealed that ROCHA had passed numerous checks in the county written on a closed account. The domestic abuse case was also investigated by the Muscatine County Sheriff's Department. In that case the defendant assaulted his wife, resulting in injuries.

The Court imposed a suspended prison sentence of not to exceed five years on the theft charge and a jail sentence of 92 days with 90 suspended on the domestic abuse charge. The defendant was also ordered to complete the batterers education program. The defendant was further ordered to make victim restitution.


ANTHONY WINSTON, DOB: 6/6/1991, of Fruitland, pled guilty to two counts of Delivery of a Controlled Substance. Investigation by the Muscatine County Drug Task Force revealed that on two occasions the defendant delivered cocaine.


RICKY JOE ZAMUDIO, DOB: 5/6/1984, of Muscatine, pled guilty to Possession of Marijuana with Intent to Deliver and Unlawful Possession of a Firearm. He was arrested by the Muscatine Police Department after the execution of a search warrant at his residence revealed that he was in possession of approximately 43 grams of marijuana and a handgun. ZAMUDIO had previously been adjudicated delinquent for conduct which would have been a felony if committed by an adult and was therefore barred from possession of a firearm.

Guilty plea to incest charges

Today, December 3, 2012, WARREN LOVELL, DOB: 12/3/1944, formerly of M&W Trailer Court, Muscatine, pleaded guilty to two counts of Incest, each a class "D" felony. Investigation conducted by the Muscatine County Sheriff's Department showed that LOVELL had engaged in sex acts with a descendent during May through August of 2012.

LOVELL remains in the Muscatine County Jail pending sentencing on January 11, 2013, at 9:15 a.m.

Muscatine County District Court November 30, 2012

The following occurred in Muscatine County District Court on November 30, 2012:

HEATHER SUE ACOSTA, DOB: 7/14/1979, of Muscatine, Iowa was sentenced for the offense of Forgery. The court imposed a sentence of incarceration for a term not to exceed five years to be served consecutively to a parole revocation sentence.

Investigation by the Muscatine Police Department showed that ACOSTA had forged a check which she had stolen.


TYLER PAINTIN, DOB: 12/11/1968, of Iowa City, Iowa was sentenced for the offense of Sexual Exploitation of a Minor. The court sentenced the defendant to serve 180 days in the Muscatine County Jail and suspended an additional 185 day jail sentence. The court also ordered that the defendant be placed on supervised release as if on parole for a period of ten years following the completion of the jail sentence. The defendant will additionally be required to register as a sex offender.

Investigation by the Muscatine Police Department showed that PAINTIN had been in possession of child pornography. PAINTIN had been held in custody since his arrest on September 20, 2012. The Davenport Police Department assisted with the investigation by conducting a forensic examination of a computer seized from PAINTIN at his arrest.


JAMIE STEINKE, DOB: 8/7/1972, of Muscatine, Iowa, pled guilty to Delivery of a Controlled Substance, a class "C" felony. Investigation by the Muscatine County Drug Task Force showed that STEINKE delivered methamphetamine during the course of an undercover investigation. STEINKE will be sentenced at a later date.
