Muscatine County District Court; Dec. 5 and 8, 2014

December 5, 2014, in Muscatine County District Court:

LANDON CHAIRES, DOB: 2/10/1991, of Muscatine, was sentenced to serve a sentence of imprisonment for a term not to exceed five years for the offense of Possession of a Controlled Substance with Intent to Deliver. The Court had originally placed CHAIRES on probation on February 15, 2013. Following a hearing the Court determined that CHAIRES violated the terms of his probation.


JUAN RAMOS COLLAZO, JR., DOB: 4/28/1991, of Muscatine, pleaded guilty to Delivery of a Controlled Substance. Investigation by the Muscatine Police Department determined that COLLAZO engaged in a drug transaction with another individual in the 500 block of East Sixth Street. He will be sentenced January 16, 2015, at 9:30 a.m.


CASEY BELL, DOB: 11/14/1971, of Muscatine, pleaded guilty to Neglect of a Dependent Person. Investigation by the Muscatine Police Department and the Iowa State Patrol showed that BELL was the operator of a motor vehicle when it struck a parked motor vehicle. BELL fled the scene of the collision. BELL’s minor child suffered injuries in the collision and was taken by the child’s mother to the hospital. Hospital staff were led to believe that the child had been injured from falling from a scooter. Upon learning the true history of the injuries hospital personnel discovered that the child had suffered a skull fracture. He was emergently transported to the University of Iowa Hospitals and Clinics where he underwent surgery. BELL will be sentenced January 16, 2015, at 9:15 a.m.


GAGE HAKE, DOB: 3/3/1996, of Muscatine, pleaded guilty to Burglary in the Third Degree. Investigation by the Muscatine County Sheriff’s Department showed that HAKE participated in the burglary of a rural residence in which property was taken.


BRIAN KEITH TULLY, DOB: 10/26/1961, of Ottumwa, was sentenced to serve a term of imprisonment for the offense of Possession of a Controlled Substance, Third or subsequent offense. TULLY had been placed on probation on September 26, 2014. He then was arrested in Henry County, Iowa on October 20, 2014, for committing a burglary. He was subsequently sentenced to serve a term of imprisonment for that burglary.


MIGUEL AGUILAR, DOB: 10/19/1994, of Muscatine was sentenced to serve terms of imprisonment for two drug trafficking felonies. AGUILAR had been placed on probation on July 12, 2013. He subsequently absconded from probation supervision.


December 8, 2014, in Muscatine County District Court:

TRAVIS VIPOND, DOB: 10/13/1981, of Muscatine, pleaded guilty to two separate charges of Theft in the Second Degree. In one case, investigation by the Muscatine County Sheriff’s Department and the Wilton Police Department showed that he participated in the theft of property from a Wilton Community Schools building. In the other case VIPOND was being treated for injuries suffered in an assault when he took medical equipment from a treatment room at Trinity Hospital in Muscatine. This case was investigated by the Muscatine Police Department. He will be sentenced January 16, 2015, at 9:45 a.m.



SHASTA JOY, DOB: 6/20/1984, of Wilton, pleaded guilty to Failure to Appear. Investigation showed that JOY had been released on bond on charges of Theft in the First Degree. She pleaded guilty and was sentenced to a suspended term of not to exceed five years to run consecutively to sentences previously imposed on the underlying offenses.

Muscatine man arrested for posting photos of nude minors on Twitter account.

Muscatine County Attorney Alan R. Ostergren announced today, December 3, 2014, that criminal charges have been filed in connection with an investigation into an individual who used the Twitter.com messaging service to post photos of nude minors.

Muscatine Police arrested BRIAR JARED TODD, DOB: 9/15/1995, of Muscatine for five counts of Sexual Exploitation of a Minor. Each offense is a class "D" felony punishable by up to five years imprisonment. TODD was arrested today without incident.

The criminal complaints allege that TODD used an account he created with Twitter.com to post five separate photos of nude female minors. The manner in which the images were posted would allow anyone following the Twitter account to receive the photos. The information on the account identified each minor by name.

TODD's next court appearance will be on December 15, 2014, at 9:00 a.m.

"The Internet is a wonderful thing for communication, education, and social networking, " said Ostergren. "It can also be a dangerous place, especially for children. I encourage parents to take an active role in what their children are doing online," he added.

The criminal charges against the defendant are merely accusations. He enjoys the presumption of innocence in court proceedings.
