Muscatine County District Court - 3/28/2014

The following occurred in Muscatine County District Court on 3/28/2014:

CHRISTOPHER FRANKS, DOB: 11/21/1972, of Letts, pleaded guilty to Possession With Intent to Deliver Methamphetamine and Possession With Intent to Deliver Marijuana. A traffic stop by a Muscatine County Sheriff's Deputy found that FRANKS was in possession of a quantity of both marijuana and methamphetamine which he intended to distribute. FRANKS will be sentenced May 9, 2014, at 9:00 a.m.

LANE GASAWAY, DOB: 2/25/1996, of Muscatine, was sentenced for the offense of Lascivious Acts with a Child. The Court imposed a suspended five year prison sentence and placed the defendant on supervised probation. In addition the defendant will be on supervised release for the next ten years and will be required to register as a sex offender. Investigation by the Muscatine Police Department showed that GASAWAY solicited a thirteen year old to engage in a sex act.

CODY WHITE, DOB: 7/11/1989, of Cedar Rapids, Iowa, pleaded guilty to Eluding and Operating a Motor Vehicle While Intoxicated. The defendant attempted to elude two Muscatine County Sheriff's Deputies after fleeing from the location of a traffic stop by a Muscatine Police Department officer. WHITE will be sentenced May 23, 2014, at 9:30 a.m.

CORY STYCH, DOB: 4/12/1991, of Muscatine pleaded guilty and was sentenced for Eluding and Operating a Motor Vehicle While Intoxicated. The defendant attempted to elude a Muscatine County Sheriff's Deputy. He was sentenced to concurrent prison sentences for a total term of not to exceed two years.

DONALD WAYNE FULSCHER, DOB: 2/1/1986, of Muscatine, pleaded guilty and was sentenced for Possession of a Controlled Substance with Intent to Deliver. Investigation showed the defendant was in possession of a distribution quantity of methamphetamine which was discovered during a traffic stop
by a Muscatine County Sheriff's Deputy. The defendant had previously been convicted of a felony offense on two separate occasions. The Court sentenced the defendant to an indeterminate term of not to exceed 15 years.

Muscatine County District Court

On Thursday, March 13, 2014:

KEENATH TURNER, DOB: 12/25/1988, of Muscatine, pleaded guilty to Theft in the Second Degree. Investigation by the Muscatine Police Department showed that he stole more than $1,000 in merchandise from the Muscatine Wal-Mart. When approached by police he attempted to flee on foot.

On Friday, March 14, 2014:

PAUL BELL, DOB: 7/11/1968, of Davenport, was sentenced for Credit Card Fraud as a Habitual Offender and received a prison term of not to exceed fifteen years. Investigation by the Muscatine County Sheriff's Department showed that BELL had used a stolen credit card to obtain property. BELL had two prior felony convictions. The Court ordered that BELL's sentence be served consecutively to another prison sentence imposed in Scott County, Iowa.

FRANCISCO BRIONES, DOB: 9/3/1978, of Muscatine, was sentenced for Delivery of a Controlled Substance. Investigation by the Muscatine County Drug Task Force showed that BRIONES had sold cocaine to a confidential informant. BRIONES was found guilty by a jury. The Court imposed a suspended prison term of not to exceed ten years and placed him on supervised probation for a term of two years.

CHARLES WIEBEL, DOB: 1/8/1994, of Durant, was sentenced for Criminal Mischief in the Second Degree. Investigation by the Wilton Police Department showed that WIEBEL damaged another person's motor vehicle. The Court granted a deferred judgment and placed WIEBEL on supervised probation for a term of two years.

RANDY DEESE, DOB: 7/27/1985, of Muscatine, was sentenced for Sex Offender Registry Violation, Second or Subsequent Offense. Investigation by the Muscatine County Sheriff's Department showed that DEESE moved from a residence in Muscatine without properly notifying the Sheriff of his new address. DEESE had previously been convicted of a registry violation. DEESE was found guilty after a bench trial. The Court imposed a prison sentence of not to exceed five years.

DONOVAN BARBER, DOB: 10/13/1991, of Muscatine, pleaded guilty and was sentenced for the offense of Stalking. Investigation by the Muscatine Police Department showed that BARBER had stalked the mother of his child in violation of a protective order from May through November of 2013. The Court imposed a prison term of not to exceed two years and also imposed sentences for violation of probation totaling 270 days. The sentences were run consecutively.

Jury returns guilty verdicts

Today, March 6, 2014, in Muscatine County District Court, a jury returned a verdict of guilty against JOSE LUIS GALLEGOS-GARCIA to the offenses of Operating a Motor Vehicle while Intoxicated, Third or subsequent offense and Driving while Revoked. The trial commenced March 5, 2014.

The defendant had been arrested by a officer with the West Liberty Police Department after he observed the defendant was intoxicated during a traffic stop. Subsequent breath testing showed that the defendant's blood alcohol concentration was 0.160%. The officer also determined that the driving privileges of GALLEGOS-GARCIA had been revoked for a previous OWI conviction. In total, GALLEGOS-GARCIA has had three previous convictions for OWI.


GALLEGOS-GARCIA will be sentenced May 1, 2014, at 9:00 a.m.
