Muscatine County District Court, 4/25/2014

KEENATH TURNER, DOB: 12/25/1988, of Muscatine, was sentenced after pleading guilty to Theft in the Second Degree. The Court imposed a prison sentence for a term not to exceed five years and a suspended fine of $750. Investigation by the Muscatine Police Department showed that the defendant stole approximately $1,400 in merchandise from Wal-Mart. The defendant had an extensive criminal history which included a prior revocation of probation for a felony offense.

DONALD CLARK, III, DOB: 9/12/1972, of Muscatine, pled guilty to Possession of a Precursor Substance. Investigation by the Muscatine Police Department showed that the defendant had been in possession of pseudoephedrine while the police were investigating an earlier disturbance. Pseudoephedrine is a precursor chemical to the manufacture of methamphetamine. CLARK will be sentenced June 13, 2014, at 9:00 a.m.

Prison Sentence for Lascivious Acts with a Child

Thursday, April 24, 2014, in Muscatine County District Court:

AQUILES ALVARADO, DOB: 11/20/1948, of Muscatine, was sentenced following his conviction by jury trial for two counts of Lascivious Acts with a Child. The Court imposed concurred prison sentences for a total term of not to exceed ten years. In addition the Court ordered that the defendant shall be on supervised release as if on parole for the remainder of his life once he completes his prison sentence. He will also have to register as a sex offender for life.

ALVARADO was found guilty after a three day jury trial in February. The case was investigated by the Muscatine Police Department. Evidence at trial showed that the defendant fondled the genitals of a child under the age of 14 on two occasions.

Guilty verdict in jury trial for domestic abuse assault

Today, April 17, 2014, in Muscatine County District Court:

ESPERANZA CHESMORE, DOB: 8/15/1978, of Muscatine, was found guilty after a jury trial on the charge of Domestic Abuse Assault, an aggravated misdemeanor. Investigation by the Muscatine Police Department showed that CHESMORE brandished a knife at and threatened her husband. CHESMORE will be sentenced at a later date to be set by the Court.

Also today:

CODY MOUSTY, DOB: 9/12/1991, of Muscatine, pleaded guilty to five offenses from three separate prosecutions. The charges were two counts of Forgery, one count of Credit Card Fraud, one count of Theft in the Third Degree, and one count of Burglary in the Third Degree. The cases were investigated by the Muscatine Police Department and related to a long series of property-related criminal offenses. MOUSTY will be sentenced June 6, 2014, at 9:30 a.m.

Yesterday, April 16, 2014:

MELISSA VOGT, DOB: 2/8/1981, of Muscatine, pleaded guilty to two counts of Identity Theft and one count of Credit Card Fraud. Investigation by the Muscatine Police Department showed that she obtained a credit card account using another person's identity and then purchased merchandise with the credit card. She will be sentenced May 30, 2014, at 9:45 a.m.

JAMIE RICKEY, DOB: 5/6/1981, of Muscatine, pleaded guilty Possession of a Controlled Substance, Third Offense. Investigation by the Muscatine County Sheriff's Office showed that he was in possession of methamphetamine while a passenger in a motor vehicle. RICKEY had two prior possession convictiones. He will be sentenced June 6, 2014, at 9:15 a.m.

Prison Sentence for Lascivious Acts with a Child and Sex Offender Registry Violation

Today, April 16, 2014, in Muscatine County District Court:

ANDREW SCOTT MAYFIELD, DOB: 6/29/1984, of Muscatine, was sentenced after pleading guilty to Lascivious Acts with a Child and Sex Offender Registry Violation. The Court imposed consecutive prison sentences for a total term of not to exceed 12 years. In addition the defendant will be on supervised release as if on parole for the remainder of his life following his prison sentence. He will also be subject to the requirements of the sex offender registry.

Investigation by the Muscatine Police Department showed that MAYFIELD had fondled the genitals of a child. He was also in violation of his obligations under the Iowa Sex Offender Registry due to a prior juvenile adjudication for a sex offense.

The following occurred April 15, 2014, in Muscatine County District Court:

RUSTY WADDEN, DOB: 8/22/1988, of Muscatine, pleaded guilty to Burglary in the Third Degree and Theft in the Second Degree. Investigation by the Muscatine County Sheriff's Office showed that he entered a commercial building and stole property stored inside. He will be sentenced May 30, 2014, at 9:15 a.m.


JARED WOOD, DOB: 7/12/1989, of Muscatine, pleaded guilty in two cases. In one he pleaded to two counts of Possession of a Controlled Substance, Third Offense and Driving While Revoked. In the second he pleaded to Possession of a Controlled Substance, Third Offense and Child Endangerment. Both cases were investigated by the Muscatine Police Department. He will be sentenced May 23, 2014, at 9:30 a.m.

Muscatine County District Court 4/11/2014

MCKENZIE POWELL, DOB: 10/1/1993, of Davenport, pleaded guilty to two counts of Perjury. Investigation by the Muscatine Police Department showed that POWELL had made two false statements in a deposition taken of her after she had been identified as a witness in the prosecution of PHILIP AHRENS for a felony assault. POWELL falsely denied an earlier statement made under oath which identified AHRENS as the perpetrator of the assault. She also falsely denied having had any telephonic contact with AHRENS while he was in jail awaiting trial on his charge. AHRENS has already pleaded guilty in his case and has been sentenced to prison.

"This case shows that lying by witnesses cannot be tolerated," said Muscatine County Attorney Alan Ostergren. "I am pleased with this guilty plea because it shows that McKenzie Powell has been held accountable for attempting to deceive the court system," he continued. POWELL will be sentenced May 23, 2014, at 9:45 a.m.


JUAN MARCOS LIENDO, DOB: 4/30/1995, of Muscatine, pleaded guilty to Attempted Burglary in the Second Degree, Child Endangerment, Domestic Abuse Assault Causing Injury, and Possession of a Controlled Substance. Investigation by the Muscatine Police Department showed that LIENDO entered a residence where the mother of his minor child and that child were present. LIENDO assaulted the mother and fled the scene. He was later arrested by police and found to be in possession of marijuana. He will be sentenced May 30, 2014, at 9:30 a.m.


THOMAS DEAN BYRD, DOB: 7/21/1979, of Muscatine, was sentenced after pleading guilty to Failure to Appear. BYRD had failed to appear in court after having been released for a previous felony prosecution. The Court imposed a suspended sentence of incarceration and placed BYRD on probation along with the disposition of his prior felony case. Should BYRD later violate the terms of his probation he will be required to serve the sentences consecutively.

Guilty Pleas in Robbery of Muscatine Gas Station

Today, April 1, 2014, in Muscatine County District Court:

ASHTON DIX, DOB: 6/25/1992, and SCOTT FRY, DOB: 9/21/1990, both of Janesville, Wisconsin, pleaded guilty to Robbery in the Second Degree and Theft in the Second Degree. The men had been arrested on January 7, 2014, after they were apprehended following a pursuit.

Investigation showed that the men entered the GM Food Mart in Muscatine, Iowa where they produced pellet guns and demanded money from the clerk. The men then fled northbound on U.S. Highway 61. A Muscatine County Sheriff's Deputy caught up with the men and initiated a pursuit which ended when the men crashed their vehicle near the intersection of Hwy. 61 and 110th Street in rural Scott County. It was later determined that the motor vehicle that DIX and FRY were operating had been reported stolen from Moline, Illinois.

Investigation by the Muscatine Police Department showed that DIX and FRY were still in possession of the proceeds of the robbery and the pellet guns which they had used.

Robbery in the Second Degree is a class "C" felony and Theft in the Second Degree is a class "D" felony. The two men each face a mandatory minimum of seven years imprisonment before they would be eligible for parole. Bond was revoked and sentencing was scheduled for May 9, 2014. They remain in the Muscatine County Jail.

Also in Court today:

PANTALEON ACOSTA, DOB: 7/27/1970, of Davenport, pleaded guilty to Operating a Motor Vehicle While Intoxicated, Third or Subsequent Offense. Investigation by the Iowa State Patrol and the Durant Police Department showed that ACOSTA was operating a vehicle on County Road F58 near Stockton. A caller to dispatch had reported ACOSTA as driving erratically. Subsequent testing showed that he had a blood alcohol concentration of 0.262%. ACOSTA had six prior convictions for Operating a Motor Vehicle While Intoxicated. Because of his status as a habitual offender he faces a maximum term of not to exceed fifteen years and a three year mandatory minimum when he is sentenced.
